No Trespassing Procedure

The Urbana Police Department issues notices of no trespassing on behalf of property owners, occupants, and businesses. These notices serve as official records documenting trespassing incidents, containing information such as the trespasser's identity, the location of the trespass, and the Urbana Police Department officer handling the case. Each notice is produced on a triplicate form, with copies kept by the property owner or occupant, the trespasser, and the Department.

Should individuals trespass after receiving such a notice from an Urbana Police officer, they may be issued either a State Notice to Appear or a City of Urbana Notice to Appear, depending on the circumstances.

However, it's not necessary to involve the police to issue a notice of no trespassing. Any individual or representative of a business or property can issue one themselves, using one of two methods:

  1. Complete a written notice of no trespassing. Below is a provided form for your convenience. Simply fill it out with the available information and give it to the trespasser.

  2. Verbally inform the trespasser that they are not welcome on the property, and warn them that returning will result in arrest for trespassing. It's important to document this warning in writing for future reference.

Examples of criminal trespass to real property include:

  • Knowingly and unlawfully entering or remaining within a building.
  • Entering another person's property after being explicitly told entry is forbidden.
  • Refusing to leave someone else's property when instructed by the owner or occupant.
  • Using false documents or misrepresenting one's identity to gain permission to enter or stay on a building or land.
